Welcome to Ryan Talks Real Estate (“RTRE”, the “Site”). These Terms of Use (“Terms”) form a binding agreement between you and HomeSmart First Class Realty (Broker: Ryan Cook) regarding your access to and use of this Site and any content, tools, emails, calculators, or services we provide (collectively, the “Services”).
By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Listing information is provided in part by MLSPIN (Massachusetts) and/or Statewide MLS (Rhode Island). Information is deemed reliable but not guaranteed; availability, pricing, and terms may change without notice. Listings shown may be listed by other brokers; attribution to the listing broker appears on property cards or detail pages.
4) Eligibility & acceptable use
- You must be 18+ to use the Services.
- Do not reverse engineer, scrape, or harvest data from the Site; do not interfere with security or access controls.
- Do not submit unlawful, misleading, or infringing information, or anything that violates MLS rules, fair housing laws, or privacy rights.
5) Accounts, emails, and messages
If you subscribe to emails or submit forms, you agree to receive the communications described. You can unsubscribe at any time using the link in each email. See the Privacy Policy for details on how we handle your information.
6) Third-party links & tools
The Services may link to third-party sites (e.g., MLS sources, mortgage calculators, scheduling tools). We do not control and are not responsible for third-party content or practices.
7) Intellectual property
All Site content, logos, designs, and tools are owned by RTRE or its licensors and are protected by law. You may not copy, modify, or redistribute except as allowed by fair use or with our prior written consent.
8) Calculators & estimates
Assumptions (e.g., interest rate, down payment, expense factors) may be provided by you or defaulted by the tool. Results are illustrative and may differ from actual outcomes due to market conditions, lender terms, taxes, insurance, vacancies, repairs, and other variables.
9) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10) Limitation of liability
To the maximum extent permitted by law, RTRE, HomeSmart First Class Realty, and their affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising from or related to your use of the Services. Our total liability for any claim will not exceed one hundred U.S. dollars (US$100).
11) Indemnification
You agree to defend, indemnify, and hold harmless RTRE, HomeSmart First Class Realty, and their affiliates from any claims or losses arising out of your use of the Services or your violation of these Terms.
12) Changes to the Services or Terms
We may modify the Services or these Terms at any time. If we make material changes, we will post an updated date at the top of this page. Your continued use after changes means you accept the new Terms.
13) Governing law & venue
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflicts of laws principles. You consent to exclusive jurisdiction and venue in state and federal courts located in Bristol County, Massachusetts.
